1. Overview

This website, afrilegacy.net (the "Site"), is operated by AfriLegacy LLC ("AfriLegacy", "we", "us", or "our"). By visiting the Site or buying from us, you agree to these Terms of Service ("Terms"), along with our Privacy Policy, Refund Policy, and Shipping Policy, which are part of these Terms. If you don't agree, please don't use the Site.

We may update these Terms from time to time by posting a new version on this page. Changes take effect when posted. Continuing to use the Site after changes are posted means you accept them.

2. Using our store

You must be at least 18 years old, or the age of majority where you live, to place an order. If you are younger, you may use the Site only with the involvement of a parent or guardian. You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, or to upload any harmful code.

3. Products and handmade variation

Our products are handmade in Ghana. We do our best to describe and photograph each item accurately, but because every piece is made by hand, the item you receive may vary slightly in color, pattern, size, weave, or finish from the photos. Natural variations are part of the character of handmade goods and are not defects. Product colors may also look different depending on your screen. Our drums are handcrafted cultural instruments sold as decorative or musical items, not as professional-grade instruments.

4. Pricing and availability

All prices are listed in US dollars. Prices, products, and availability may change without notice. Many items are one of a kind and may sell out. We reserve the right to limit quantities, or to refuse or cancel any order (for example, if an item is unavailable, a pricing or listing error has occurred, or we suspect fraud). If we cancel an order after you have paid, we will refund you in full.

5. Orders and payment

We accept major credit and debit cards, PayPal, Apple Pay, Google Pay, and Venmo. Payments are processed securely by Shopify and our payment providers, and we do not store your full card details. By placing an order, you confirm that the payment information you provide is accurate and that you are authorized to use the payment method. Applicable sales tax is calculated at checkout.

6. Shipping, returns, and refunds

Shipping is governed by our Shipping Policy, and returns and refunds are governed by our Refund Policy. Risk of loss passes to you when your order is handed to the carrier, though we will always help with damaged or lost shipments as described in those policies.

7. Intellectual property

All content on the Site, including text, photos, graphics, logos, and the AfriLegacy name, belongs to AfriLegacy or its licensors and is protected by law. You may not copy, reproduce, or use it for commercial purposes without our written permission.

8. Reviews, comments, and submissions

If you send us or post reviews, photos, comments, or other content, you give us a non-exclusive, royalty-free right to use, display, and share that content in connection with our business. You agree that your content will be truthful and lawful and will not infringe anyone else's rights. We may remove any content at our discretion.

9. Third-party links and services

The Site may link to or use third-party services such as Shopify, payment providers, and shipping carriers. We are not responsible for their content, policies, or practices, and your use of them is subject to their terms.

10. Disclaimer of warranties

Except as stated in our Refund Policy, the Site and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not guarantee that the Site will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent permitted by law, AfriLegacy LLC and its owners, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our products. Our total liability for any claim related to a purchase will not exceed the amount you paid for that order. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless AfriLegacy LLC from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

13. Governing law

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts serving Lake County, Indiana, and you consent to the jurisdiction of those courts.

14. Severability and entire agreement

If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with the policies referenced above, are the entire agreement between you and AfriLegacy regarding your use of the Site.
